1. Who we are
Crunchy.Host is run by Sergei Vladimirovitsj Saliukov, a sole proprietorship (eenmanszaak) registered with the Dutch Chamber of Commerce under KVK number 95500324, VAT number NL005157504B44, Hora Siccamasingel 47, 9721HA Groningen, the Netherlands. In these terms "we" and "us" means Crunchy.Host and "you" means the person or business using our services.

2. The agreement
These terms, the acceptable use policy and the privacy policy form the agreement between you and us. You accept them when you create an account. If the documents conflict, these terms apply, except that the acceptable use policy decides how we handle abuse.
3. Who can use the services
- You must be at least 16 years old.
- If you are under 18, you need permission from a parent or guardian to create an account and pay. The parent or guardian is responsible for purchases made with their permission.
- If you sign up for a business, you confirm you are allowed to bind that business to these terms.
- You may not use the services if you are subject to EU, Dutch or UN sanctions, or if providing the services to you would break sanctions law.
4. Your account
- Give accurate details and keep them up to date, including your billing address.
- Keep your login details secret. You are responsible for everything done through your account, including by people you give access to your server.
- Tell us straight away if you think someone else has access to your account.
- One account per person. Accounts may not be shared, sold or transferred.
5. The service
We provide managed game servers. We may also offer Discord bot hosting and virtual dedicated servers (VDS). In these terms, "server" means any of these services, and the same rules apply to all of them unless a plan says otherwise. Each plan lists its memory, storage and CPU share. Memory and storage are reserved for your server. CPU cores are shared between servers on the same machine, and the fair use rules in the acceptable use policy apply.
- We provision a server after payment. Provisioning times we publish are estimates, not guaranteed timeframes.
- We may replace hardware, move your server to another machine or change the network provider, as long as your plan's resources stay the same or better. We tell you in advance when a move changes your server's IP address.
- We run the services on a best-effort basis and do not offer an uptime guarantee (SLA). We may give credit for long outages at our discretion.
- We announce planned maintenance in advance where we can. Emergency maintenance for security or stability can happen without notice.
- Features marked as beta or preview may change or disappear at any time and come without guarantees.
- Support is available through tickets, email and our Discord server. We aim to answer quickly but do not guarantee response times.
- We help you move a server from another host where we can. Migration help is best effort. We do not guarantee that it succeeds or how long it takes.
6. Balance and payment
- Your account has a balance in euros. You top it up through Stripe with a card or another method Stripe offers. We do not store your full card number.
- Ordering or renewing a server takes its price from your balance. Servers are prepaid for the period you choose and run until that period ends.
- Prices are in euros and include any VAT. Checkout shows the total before you pay.
- Email us if you need an invoice for a payment.
- Promotional credit, for example from gift codes, is not money you paid. It cannot be refunded and may not be usable for every plan.
Renewal and cancellation
- Each server has an auto-renew switch. If it is on when the paid period ends, we take one more month from your balance. If your balance is too low, the server is not renewed. We never charge a saved payment method automatically: top up and renew yourself in the billing panel.
- You can turn off auto-renew with one click in the billing panel. That is how you cancel. There is no cancellation fee, and your server keeps running until the paid period ends.
- If we change a price, we email you at least 30 days before the new price applies. A new price never applies to a period you have already paid for, and you can cancel before it takes effect.
7. Refunds
3-day money-back
If you are not happy, ask for a refund within 3 days (72 hours) of ordering a server and we refund the full price of that server. The refund goes back to the card or payment method you topped up with, or to your balance if you prefer. You do not need to give a reason. We will ask what went wrong, but answering is optional. This applies once per server. We may refuse repeated order-and-refund cycles or clear abuse.
Trials
You can ask for a free 24-hour trial by opening a ticket. One trial per person. We may decline trial requests.
Other refunds
After the 3-day period, a period that has started is not refundable, except under the right of withdrawal in section 8, when we end or discontinue a service without you being at fault (section 13), or where the law requires it. Balance you topped up and have not spent is refunded to your payment method on request.
8. Right of withdrawal (EU and UK consumers)
If you are a consumer in the EU, EEA or UK, you may withdraw from a contract within 14 days of entering into it, without giving a reason.
- At checkout you ask us to start the service right away, inside the withdrawal period. If you then withdraw, you pay only for the time your server was available, calculated pro rata from the price. We refund the rest.
- To withdraw, send a clear statement to [email protected] or open a ticket. You can use the model form at the end of these terms, but you do not have to.
- We refund within 14 days of receiving your withdrawal, to the payment method you paid with or to your balance if you prefer.
In the first 3 days, the money-back rule in section 7 applies instead and refunds the full price.
9. Expiry and data deletion
- We email you 7 days and 3 days before a server's paid period ends.
- If the period ends and the server is not renewed, we suspend it. It stops running but its files are kept.
- Renew within 10 days of the expiry date and we restore the server as it was.
- After 10 days we permanently delete the server and its files. We email you at least 3 days before that happens. Deleted files cannot be recovered.
10. Chargebacks
If you dispute a payment with your bank or card issuer, we may suspend your account until the dispute is resolved. If the dispute turns out to be unjustified, you still owe the payment. We do not charge a chargeback fee. Contact us first. A ticket is usually resolved faster than a bank dispute.
11. Your content and backups
- You keep all rights to the files, worlds, configs and other content on your server. You allow us to store, copy and transmit it only as far as needed to run the services.
- You are responsible for keeping your own backups. Backups we make are an extra. We do not guarantee that a backup is complete or can be restored.
- You can download your files through the panel or over SFTP while the server is running. A suspended server cannot be accessed until you renew it, and deleted files cannot be recovered (section 9). Download anything you want to keep before the paid period ends.
12. Personal data on your server
Your server may process personal data of your players, such as usernames, IP addresses and chat logs. For that data you are the controller and we are your processor under Article 28 of the GDPR. How we handle our own customer data is described in the privacy policy. For data on your server we:
- process it only to run the services, following these terms and your server configuration, unless the law requires otherwise;
- make sure people with access to it are bound by confidentiality;
- use appropriate security measures, as described in the privacy policy;
- use the sub-processors listed in the privacy policy. We give you 30 days' notice before adding or replacing one. If you object and we cannot resolve it, you can end the affected service and get a pro-rata refund of the unused period;
- help you, where we reasonably can, with requests from your players and with data breaches;
- tell you without undue delay if we become aware of a breach affecting this data;
- delete the data when the service ends, as described in section 9;
- give you the information you need to show that these obligations are met.
13. Suspension and termination
- You can stop at any time by turning off auto-renew. Stopping does not refund the current period, except under section 7 or 8.
- We may suspend or end services that break these terms or the acceptable use policy. The acceptable use policy explains when we warn first and when we act immediately, and how to appeal. If we end a service for a serious violation, you do not get a refund.
- We may end a service or close an account for any other reason with 30 days' notice. If we do, or if we discontinue a service you use, we refund the unused part of your prepaid period.
- If something outside our reasonable control stops a service for more than 30 days in a row, either of us can end that service, and we refund the unused part of your prepaid period.
14. Games and third-party software
- You must follow the license terms of the games, mods and plugins you run, such as, but not limited to, the Minecraft EULA and the Hytale terms. That includes their rules on monetizing servers.
- We are not affiliated with or endorsed by any game publisher. Game names and logos belong to their owners and appear on our site only to describe what our servers run.
- We are not responsible for games, mods, plugins or other third-party software, or for changes their publishers make.
15. Reselling
You may not resell our services without our written permission.
16. Liability
- Our total liability to you is limited to the amount you paid us in the 3 months before the event that caused the damage.
- We are not liable for indirect damage, such as lost profits, lost revenue from your server, lost donations or lost data you did not back up.
- We are not liable for failures outside our reasonable control, such as outages at our datacenter or network provider, attacks larger than our DDoS protection can absorb, or power and internet failures.
- These limits do not apply to damage caused by our intent or gross negligence, to death or personal injury, or where consumer law does not allow them.
- If you are a business, you cover our costs from third-party claims caused by your content or your breach of these terms or the acceptable use policy.
17. Changes to these terms
We may change these terms. For changes that affect you, we email you at least 30 days before they take effect. If you do not agree, you can cancel before then and we refund the unused part of your prepaid period. Changes needed for legal reasons, or that only benefit you, can take effect sooner. The date at the top shows the current version.
18. Law and disputes
- Dutch law applies to these terms.
- If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
- Disputes go to the District Court of the Northern Netherlands (Rechtbank Noord-Nederland). If you are a consumer, you have one month after we invoke this clause to choose the court that is competent by law instead, and you can also go to the courts where you live if your local law allows it.
- Contact us first. Most problems get solved in a support ticket.
19. Other provisions
- If a court finds part of these terms invalid, the rest stays in force, and the invalid part is replaced by a valid rule closest to its purpose.
- We may transfer this agreement to a successor of our business. We tell you beforehand, and you can cancel if you do not agree.
- We communicate by email and through the billing panel. Messages to the email address on your account count as received.
- If we do not enforce a right straight away, we have not given it up.
- Rules that by their nature should outlast the agreement stay in force after it ends, such as payment you still owe, data deletion (section 9), liability (section 16) and disputes (section 18).
- These terms are written in English, and the English version applies.
